Terms and Conditions

1. Acceptance of Terms

By accessing and using the Pinecode lead generation platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Pinecode provides a lead generation platform that connects businesses with qualified prospects through various advertising channels including social media platforms, premium advertising networks, and enterprise channels. Our service includes:

  • Lead identification and qualification
  • Social network advertising integration
  • Advanced targeting and analytics
  • Lead management and tracking tools

3. Pricing and Payment Terms

Pinecode operates on a pay-per-qualified-lead model with the following pricing structure:

  • Social Media Leads: $40 per qualified lead
  • Premium Channels: $50 per qualified lead
  • Enterprise Channels: $60 per qualified lead

Payment is due within 30 days of invoice date. Late payments may incur additional fees. All prices are subject to change with 30 days written notice.

4. Lead Qualification Criteria

A qualified lead is defined as a prospect who:

  • Meets your specified demographic and firmographic criteria
  • Has expressed genuine interest in your product or service
  • Has provided accurate contact information
  • Has not been previously contacted by your organization within the past 90 days

5. Client Responsibilities

As a client of Pinecode, you agree to:

  • Provide accurate information about your target audience and requirements
  • Respond to qualified leads in a timely and professional manner
  • Comply with all applicable laws and regulations in your marketing activities
  • Not use our service for any illegal or unethical purposes
  • Maintain the confidentiality of any proprietary information shared

6. Data Protection and Privacy

Pinecode is committed to protecting the privacy and security of all data processed through our platform. We comply with applicable data protection laws including GDPR and CCPA. For detailed information about our data practices, please refer to our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of the Pinecode platform are owned by Pinecode and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

Pinecode's liability for any claims arising from the use of our service shall not exceed the amount paid by the client in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

9. Service Availability

While we strive to maintain 99.9% uptime, Pinecode does not guarantee uninterrupted service availability. We reserve the right to perform maintenance and updates that may temporarily affect service availability.

10. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, you will be responsible for payment of all qualified leads delivered up to the termination date. Data retention and deletion will be handled according to our Privacy Policy.

11. Dispute Resolution

Any disputes arising from this agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Odessa, Texas.

12. Modifications to Terms

Pinecode reserves the right to modify these terms at any time. We will provide 30 days notice of any material changes. Continued use of the service after such modifications constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms shall remain in full force and effect.

16. Entire Agreement

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Pinecode regarding the use of our service and supersede all prior agreements and understandings.
